This Privacy Policy explains how NewlandRock collects, stores and processes your personal data.

About NewlandRock:

NewlandRock is a trading entity of BartonRock Limited (company no. 12576331) and is referred to in this Policy as “NewlandRock”).

Our registered office is 14 Clarendon Street, Nottingham, NG1 5HQ, UK.

NewlandRock’s services:

NewlandRock provides human capital related services. This includes but is not limited to leadership effectiveness, leadership development and assessment, HR/business advisory and executive coaching.

The company gathers personal data to complete its services to clients. Personal information is stored, processed and transferred at various stages of these services both during and sometimes after client engagements are completed.

Purpose of privacy policy:

The purpose of this policy is to confirm how NewlandRock uses your personal data in line with the General Data Protection Regulation that became law in May 2018.

Data collected about you:

NewlandRock collects Personal Information to provide services to our clients and to operate our business. The type of Personal Information we collect about you depends on the service offering being delivered.

During our services, we may collect Personal Information such as your: name, e-mail address, telephone number, location, first language, CV / Resume aspects (e.g. job title, work history, education) and references.

For assessment a client may request demographic information to be included within the project reporting. For instance, for services relating to diversity and inclusion agendas we may include demographic questions on: gender, race, age or ethnicity.

If necessary, we will ask for information regarding your physical health for accessibility purposes.

Please do not provide us with any Personal Information if you do not agree with this Policy.

How do we collect your personal data?

We may collect personal data about you directly or from public sources such as LinkedIn or similar sites, company websites and word of mouth referrals and recommendations.

Personal Information about you may also come from our clients to whom we provide Services. These clients may be your employer or an organisation with which you are seeking employment.

If you are not already known to NewlandRock and we collect any of your personal data, we will advise you within 60 days via email.

Sensitive personal data collected requires your explicit consent.

When signing up to a newsletter or similar on our website (www.newlandrock.com) you will need to provide the necessary details asked for.

Why do we collect personal data?

We require personal data to perform advisory services in line with the quality standards we adhere to. Fulfilling client requests: our contractual obligations with a client, where you may be a current or prospective employee of that client.

We use third parties, who comply with similar undertakings of privacy and confidentiality. They perform outsourced operational functions on our behalf. These organisations include:

  • Associate Consultants.
  • Psychometric Assessment providers

We may also be required to release Personal Information to regulatory or law enforcement agencies. We will also disclose information where we are requested to do so by law.

As defined under GDPR, NewlandRock is a data controller. This relates to the way in which we work with our clients and with you.

Where a client has requested we provide a leadership consulting service to them which relates to you, this service will always be commissioned by our client with your knowledge and agreement. This service may be in relation to assessment (for recruitment or development), coaching, workshops, psychometrics or other leadership consulting services.

At the beginning of our engagement, we will ask for basic information like contact details. During an assessment process you will be asked, verbally, to share personal and career history. We will also ask you to complete psychometric profiling tests.

Your assessment report will make recommendations to our client about your potential and/or development profile. Your psychometric profiling data will form part of an overall assessment by the consultant. This assessment report is developed individually by the consultant and is not automated. This report may be included to your coaching schedule and shares with the selected coach as discovery information to ensure a relevant coaching contract is created.

Whenever your record appears in an analysis from our benchmarking database, this will be in aggregated and anonymised form, and you will not be identifiable by the recipient of such an analysis.

How long do we keep your data for?

We will only keep your personal data for as long as we need to fulfil our client obligations or our legal requirements.

Legal basis for holding your data:

The basis for holding your personal data is determined by NewlandRock’s contractual obligations and where there is a legitimate business interest. We will also hold the data when you have provided us with your consent to do so, either directly or through the client we serve. If you withdraw consent and request to be removed then this will be completed immediately.

How do we share your personal data?

We will only share your personal data with clients who have a working relationship with NewlandRock. Our international client base includes, but is not limited to: retail, consumer, technology, financial services, insurance, pharmaceutical and biotech.

Your rights?

By law you have certain rights available to you regarding your personal data. Further information is available from your country’s data regulator.

These include:

  1. To be informed– you have the right to be provided with transparent, coherent information about how we use your data and your rights in relation to the use of your data. That is why we’ve provided this policy.
  2. Access– you have the right to access your information (if we are processing it) and certain other information (such as provided in this policy). This is so you are aware and check we are using it in accordance with the data protection law.
  3. Rectification– you have the right to have your information corrected if it is inaccurate or incomplete.
  4. Deletion – this enables you to request the deletion or removal of your information where there is no compelling reason for us to continue using it. There are exceptions to the right to erasure.
  5. Restrict processing– You have the right to “block” or suppress further use of your information. When processing is restricted, we can still store your information, but may not use it further. We will keep a list of those who have asked for it to be restricted so that their request is respected.
  6. Data portability– you have the right to transfer your personal data to another provider. You can move, copy and transfer data easily between our IT systems and their systems safely and securely without affecting its usability.
  7. Object to processing– you have the right to object to certain types of processing, including for direct marketing, including for potential opportunities.
  8. Lodge a complaint– you have the right to make a complaint about the way we handle or process your data with your national data protection regulator.
  9. Withdraw consent– if you have given your consent to anything we do with your personal data, you have the right to withdraw your consent at any time (although if you do so, it does not mean that anything we have done with your personal data with your consent up to that point is unlawful). This includes your right to withdraw your consent with us for marketing purposes.

Access to your information:

You may request information about the personal data we hold. Subject access requests should be sent to info@newlandrock.com Handling of these requests will be free of charge but we may charge a reasonable fee if we receive repeated or excessive requests or further copies of the same information. We will respond within 14 days of submitting the request.

Updates to this Policy:

We will keep this policy updated in response to changes in data privacy law.

Cookies:

We use cookies, pixels and tags (which we shall collectively define as “Cookies”) on our website to personalise content, to provide social media features and to analyse our traffic. We also share information about your use of our site with our social media, advertising and analytics partners who may combine it with other information that you’ve provided to them or that they’ve collected from your use of their services.
